Special report on challenging the legal validity of alleged credit card debt

Greetings,

Louis J. Pinga, Honorary Colonel Auctioneer who graduated from the Florida Auctioneer Academy in 1992 challenged the legal validity of an alleged credit card debt in 2015. Ancient Greeks and Romans used to stone people to collect alleged debts. Thankful today it is a little more civilized. We iron our differences in the Court of law. It's only as civilized as you know the law. Judges and lawyers will rack you over the coals if you aren't familiarized with the laws including your own lawyer.

Many years ago before the roll-out of the Commercial World Wide Web Louis consigned some very valuable coins to a Warwick, RI coin shop. Louis received a handwritten agreement from the owner on a small pad. Mind you one of the coins consigned was a 1909-S VDB Lincoln Cent along with all the other key dates in the set. This coin store took possession of Louis' Lincoln Cent set and Mercury Dime set but refused to pay him when they were sold. 

This transaction was not classified as a trespass of property since there was a contract involved. Thus, Louis had no recourse at a Police station since it was a business transaction. The only potential recourse Louis had was filing a RICO lawsuit in Superior Court acting as a "Private Attorney General". The problem with that Louis didn't have the knowledge necessary to litigate a RICO lawsuit at the time and couldn't afford an attorney. Even if Louis could afford an attorney the costs of the lawsuit exceeded the potential benefit. 

This situation motivated Louis to study the laws, especially the laws as they pertain to fraud. In fact, Louis as a Pro Se litigant even Counter claimed Chase Bank's Small Claims lawsuit for $923.53 on alleged credit card debt on the basis of ab initio FRAUD, fraud on the contract, fraud on the court, and fraudulent conveyance. Fraud? Kindly look up the definition of Fraud in Black's Law Dictionary and answer that question yourself.

Frauds, Statute of. "This is the common designation of a very celebrated English statute (29 Car. II, c. 3), passed in 1677, which has been adopted, in a more or less modified form, in nearly all of the United States. Its chief characteristic is the provision that no suit or action shall be maintained on certain classes of contracts or engagements unless there shall be a note or memorandum thereof in writing signed by the party to be charged or by his authorized agent (e.g., contracts for the sale of land, contacts which cannot, by their terms, be performed within a year; and contracts to guaranty the debt of another). Its object was to close the door to numerous frauds and perjuries." It is more fully named as the "statutes of frauds and perjuries."

During mediation, the lawyer for Plaintiff, Chase's assignment of the alleged debt said, "there is no contract."

The final disposition of the case resulted in a dismissal. Louis never filed for bankruptcy protection throughout his whole life. Donald Trump filed for bankruptcy at least 4 times before serving as President. Louis isn't saying that he is more intelligent than Donald Trump.  Alternatives exist to filing bankruptcy. If someone files for bankruptcy they can kiss goodbye to ever becoming a Stockbroker, Banker, or numerous other professions.
